Lawsuits allege that cow's milk-based infant formulas made by Abbott (Similac) and Mead Johnson (Enfamil) increase the risk of necrotizing enterocolitis (NEC) in premature infants and that manufacturers failed to warn hospitals and parents. Hundreds of cases are pending in federal MDL and in state courts. Bellwether trials and settlement discussions are ongoing.
Infant Formula NEC cases are consolidated in MDL No. 3026 in the Northern District of Illinois. The MDL includes claims against Abbott Laboratories (Similac) and Mead Johnson (Enfamil). Bellwether trials help the parties and court evaluate common issues. State court cases proceed separately—some have resulted in large plaintiff verdicts. In July 2025 the court ordered a census of filed and unfiled claims to support settlement talks.

Research has suggested that premature infants fed cow's milk-based formula have a higher risk of developing NEC compared with those fed human milk or donor human milk. Lawsuits allege that formula manufacturers knew or should have known of this risk and failed to adequately warn NICUs and parents.
